Staff Analysis of the Legislation

This bill works to ensure that local governments are put on notice before the federal government initiates a prescribed fire. Under the Clean Air Act, the Department of Environmental Quality (DEQ) is authorized to grant permits to federal agencies that oversee prescribed fires on public and private land. This bill requires that the federal government consider local resources in their burn plan and notify and consult with local governments on all prescribed fires before the DEQ may issue the permit.
